1. SPONSOR
The ROMchip Fundraiser Raffle ("Sweepstakes") is sponsored by ROMchip, LLC ("Sponsor"), located at 767 Broadway, #1102, New York, NY 10003.
2. ELIGIBILITY
The Sweepstakes is open to legal residents of the United Stated and its territories who are at least 18 years old at the time of entry. Employees, officers, and directors of Sponsor, its affiliates, advertising and promotion agencies, and their immediate family members and/or those living in the same household are not eligible to participate.
3. SWEEPSTAKES PERIOD
The Sweepstakes begins on February 22 at 11AM ET and ends on February 22 at 11PM ET ("Sweepstakes Period"), and consists of Prize Rounds, as outlined in the final Paragraph below. Sponsor's computer is the official time-keeping device for the Sweepstakes.
4. HOW TO ENTER
The Sweepstakes Period is divided into separate Prize Rounds. Each Prize Round corresponds to one or more specific prizes, as described in the scheduled linked at the end of these Official Rules.
In order to be automatically entered to win a prize, go to https://hcb.hackclub.com/donations/start/romchip-a-journal-of-game-histories (the “Website”) and follow the on-screen instructions to make a donation to Beneficiary that meets the minimum specified requirement (refer to the schedule in the final Paragraph). All entries received during the specified timeframe for a Prize Round will be entered to win one of the prizes corresponding to that Prize Round, according to the schedule linked below. Additionally, anyone making donations to Sponsor of at least One Hundred US dollars ($100.00) throughout all Prize Rounds during the Sweepstake Period will be automatically entered to win a grand prize, as listed in the schedule linked in the final Paragraph. In order to be automatically entered, ONLINE DONATIONS MUST BE COMPLETED NO LATER THAN THE END TIME OF THE CORRESPONDING PRIZE ROUND.
In order to enter without making a donation, send a postcard (no larger than 5” x 7”) in an envelope with proper postage affixed to ROMCHIP LLC, 767 Broadway, #1102, New York, NY 10003, and legibly hand-print your first and last name, home address, date of birth, telephone number, and e-mail address, with the following statement, noting in which Prize Round your entry should be counted: “Please enter me in the ROMchip Fndraiser Raffle – Prize Round _.” The round must be indicated by stating the name of the streamer the prize is attached to, shown in the schedule linked in the final Paragraph. MAIL-IN ENTRIES MUST BE POSTMARKED NO LATER THAN THE NEXT BUSINESS DAY FOLLOWING THE CLOSE OF THE APPLICABLE PRIZE PERIOD AND RECEIVED NO LATER THAN March 7th 2025.
Limit one entry per household, per Prize Round, regardless of method of entry. Automated or fraudulent entries will be disqualified.
5. WINNER SELECTION AND NOTIFICATION
For each prize available in each Prize Round, and for the grand prize, one entry will be selected from all eligible entries received in a random drawing (the “Drawings”) to be a potential prize winner (“Potential Winners”). The drawing will be held on or about March 10th 2025. Winners will be notified via email at the email address provided upon entry about 1 day after the drawing. If a winner does not respond with shipping information within 7 days, an alternate winner may be selected. The Drawings will be conducted by representatives of Sponsor whose decisions are final on all matters relating to this Sweepstakes.
6. PRIZES
The prizes set forth in the schedule linked to in the final Paragraph of these Official Rules. All physical prizes retail for $25-$50 dollars, with the exception of the grand prize, which retails for $50-$125. No substitution, transfer, or cash equivalent of prizes is permitted, except at the Sponsor’s sole discretion. Sponsor is responsible only for prize delivery; not responsible for prize utility, quality or otherwise. Odds of winning depend on the number of eligible entries received. All prizes will be shipped to verified winners within one hundred and twenty (120) days of Sponsor's confirmation of shipping information. Sponsor is not responsible for lost or delayed packages.
7. GENERAL CONDITIONS
By entering, participants agree to abide by these Official Rules and the decisions of the Sponsor, which are final. Sponsor reserves the right to cancel, suspend, or modify the Sweepstakes if fraud or technical failures compromise the integrity of the Sweepstakes, if participants act in violation of the Official Rules, or act in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Furthermore, Sponsor reserves the right to disqualify any individual that has been suspended or banned from participating in, or attending Sponsor's events.
In the event an individual charges back any donation, individual will be disqualified from the Sweepstakes, and may be disqualified from future Sweepstakes managed by the Sponsor, at the Sponsor's discretion. Individual will be disqualified even if the individual has another valid means of entry. Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility in a form acceptable to Sponsor to participate in this Sweepstakes. Failure to provide such proof in a timely manner may result in disqualification.
8. RELEASE AND LIMITATION OF LIABILITY
By participating, entrants release and hold harmless Sponsor, its affiliates, and their respective officers, directors, employees, and agents from any liability arising from participation in the Sweepstakes, the acceptance, use, or misuse of any prize, or for any typographical, printing, or other inadvertent errors in the Official Rules.
Any claim or cause of action arising out of or related to this Sweepstakes or these Official Rules must be filed within one (1) year after such claim or cause of action arose regardless of any statute or law to the contrary. In the event any such claim or cause of action is not filed within such one (1) year period, such claim or cause of action shall be barred. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. WINNERS (AND THEIR PARENTS OR LEGAL GUARDIANS IF ANY WINNERS ARE MINORS) HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY'S/LEGAL FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF WINNER, IDENTIFIABLE PERSONS, OR THIRD PARTY PARTICIPANTS, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. 9. GOVERNING LAW
The Sweepstakes is governed by the laws of the State of New York giving effect to any choice of law or conflict of law rules, and shall be subject to the exclusive jurisdiction of the state and federal courts located in New York, New York.
